Booking terms

The full terms for a stay booked directly with us. They are written to be read, not to be skipped.

1Who you're booking with

Stays on this site are let by Merill Stays, based in Buġibba, Malta. Contact us at [email protected].

These terms apply to bookings made directly on merillstays.com. Bookings made through a listing site are governed by that platform's terms as well as these.

2Making a booking

A booking is confirmed when payment has been received in full and we have sent you a confirmation email containing a booking reference. Until then, dates are held for 30 minutes only and may be released.

The lead guest must be at least 18 and is responsible for everyone on the booking. The number of guests must not exceed the maximum stated on the listing. Infants under two do not count towards that maximum.

We may decline a booking, before or after payment, if we have reason to believe the property will be used for a party, an event, or any commercial purpose. Where we decline, we refund in full.

3Price and payment

The total shown at checkout is the total you pay. It includes accommodation for the dates selected, the cleaning fee, and any applicable additional-guest charges. There is no booking fee, service fee, or card surcharge.

Payment is taken in full at the time of booking, in euro, by card. Card details are processed by Stripe and are never stored on our systems.

A refundable damage deposit may be pre-authorised on your card shortly before arrival and released within seven days of checkout, less the cost of any damage beyond fair wear and tear.

Prices quoted are per stay for the dates and guest numbers selected. Changing either may change the price.

4Cancellation and changes

Cancel more than 14 days before your arrival date and we refund 100% of what you paid.

Cancel between 14 days and 48 hours before arrival and we refund 50%.

Cancel within 48 hours of arrival, or fail to arrive, and the booking is non-refundable.

Refunds are returned to the card used to pay and typically take five to ten working days to appear.

To change dates, contact us. We will always try to move a booking rather than cancel it, subject to availability; where the new dates cost more you pay the difference, and where they cost less we refund it.

If we have to cancel your booking for any reason within our control, we refund everything you have paid and help you find comparable accommodation.

5Arrival and departure

Check-in is from the time shown on your confirmation; check-out is by the time shown. Access is by lockbox, and we send the code before you travel.

Early check-in and late check-out are often possible and always free when the calendar allows. Ask us — we will confirm the day before rather than promise in advance.

6While you're staying

Please treat the apartment and the building as you would your own home, and respect the neighbours — this is a residential building, and quiet hours are between 23:00 and 07:00.

Smoking is not permitted indoors. Parties and events are not permitted. Pets are welcome by prior arrangement only.

You are responsible for loss or damage caused during your stay. Tell us about accidents; they happen, and it is far easier to sort out while you are still here.

7Liability

We maintain the property and its equipment to a good standard, and carry public liability insurance. We are not liable for loss or damage to your belongings, or for events outside our reasonable control.

We strongly recommend travel insurance covering cancellation, medical costs and personal belongings. Our cancellation policy is not a substitute for it.

Nothing in these terms limits our liability for death or personal injury caused by negligence, or for fraud.

8Complaints

If something is wrong, tell us while you are still in the apartment — the contact details are on your confirmation. Almost everything is fixable the same day, and we cannot put right what we do not know about.

Unresolved complaints can be raised with the Malta Tourism Authority.

9Governing law

These terms are governed by the laws of Malta, and the Maltese courts have exclusive jurisdiction.
